WASHINGTON (Feb. 28) - The question has nagged at the parents of Americans born outside the continental United States for generations: Dare their children aspire to grow up and become president? In the case of Senator John McCain of Arizona, the issue is becoming more than a matter of parental daydreaming.

Mr. McCain’s likely nomination as the Republican candidate for president and the happenstance of his birth in the Panama Canal Zone in 1936 are reviving a musty debate that has surfaced periodically since the founders first set quill to parchment and declared that only a “natural-born citizen” can hold the nation’s highest office.

Almost since those words were written in 1787 with scant explanation, their precise meaning has been the stuff of confusion, law school review articles, whisper campaigns and civics class debates over whether only those delivered on American soil can be truly natural born. To date, no American to take the presidential oath has had an official birthplace outside the 50 states.

“There are powerful arguments that Senator McCain or anyone else in this position is constitutionally qualified, but there is certainly no precedent,” said Sarah H. Duggin, an associate professor of law at Catholic University who has studied the issue extensively. “It is not a slam-dunk situation.”

Mr. McCain was born on a military installation in the Canal Zone, where his mother and father, a Navy officer, were stationed. His campaign advisers say they are comfortable that Mr. McCain meets the requirement and note that the question was researched for his first presidential bid in 1999 and reviewed again this time around...

I would think it makes the most sense for "natural-born citizen" to mean "citizen at birth" rather than "born on American soil." So if somebody is a citizen at birth because their parents are citizens, I think it makes sense that they'd be a "natural-born citizen" even if they were born outside the US.

I have a friend whose dad was in the army and my friend was born at an American base in Germany. He is an American citizen as Amercian bases are considered American soil. At least that's what he's been told his whole life.

So I think this idea that McCain shouldn't qualify to be President of the US because he wasn't born "in" America is bunk.

I've seen an interesting discussion about this elsewhere... it's not the same as a military base, IIRC.

As far as I know, it always has been. I think trying to declare him ineligible would be a terrible mistake, as you'd essentially be telling every service member stationed overseas that their children born while they were serving wouldn't be American citizens.

Oh yeah! My friend's twins were born in a German hospital while stationed on an American military base. They have automatic dual-citizenship.

I think the question comes from the fact that people born in Panama Canal Zone, even to US parents, have to apply for a special certificate of naturalization, which is pretty much rubber stamped allowing citizenship. If this is what happened with McCain, I can understand why it would be a question. I would hate to see him DQ'd because of this though. I'm not a huge fan of the "natural born citizen" clause of the Constitution anyhow.

Interesting article. While I'm not going to vote for McCain, he should not be disqualified over this.

However, I do think some legal clarification is needed, not only for McCain, but for all children of US citizens born abroad and on base.
